Law Enforcement Guidelines

These guidelines explain how law enforcement officials may request data from Astr LLC, a Wyoming limited liability company (“astr,” “we,” “us”), and how we handle those requests. They are intended for law enforcement and do not create any rights, contractual or otherwise, in favor of any party. We are based in the State of Wyoming, United States, and we respond to valid legal process in accordance with U.S. law, including the Stored Communications Act (18 U.S.C. § 2701 et seq.).

Send all requests, on official letterhead, to legal@astr.lovewith subject line “Law Enforcement Request.” Please include:

• The requesting agency, the name and badge/ID of the requesting official, and a return official email and phone number.
• The specific account(s) at issue, identified by the user's email address or username.
• A description of the data sought and the applicable legal process compelling it.
• A response deadline that allows reasonable time to process (see below).

• Subpoena. Required to compel basic subscriber information (e.g., name on file, email address, account-creation date).
• Court order (18 U.S.C. § 2703(d)). Required for non-content records and other transactional information.
• Search warrant. Required, based on probable cause, to compel the contents of communications (e.g., messages) and other stored content.

Requests from outside the United States should be submitted through a U.S. court by way of a mutual legal assistance treaty (MLAT) or letter rogatory.

In emergencies involving a danger of death or serious physical injury to any person, we may voluntarily disclose information to law enforcement without legal process, as permitted by 18 U.S.C. § 2702. Submit emergency requests to legal@astr.lovewith “EMERGENCY DISCLOSURE REQUEST” in the subject line, and describe the nature of the emergency, the specific danger, and how the requested information will help address it.

On receipt of a valid preservation request under 18 U.S.C. § 2703(f), we will preserve available account records for 90 days, renewable once for an additional 90 days on renewed request, pending service of valid legal process.

We can only produce data we actually have. We collect the data described in our Privacy Policy; we do not retain data we never collected. We do not perform background checks on users and cannot verify the real-world identity of any account.

Our policy is to notify users of requests for their information before disclosure, so they may seek to protect their rights, unless we are legally prohibited from doing so (for example, by a valid non-disclosure order) or unless we believe in good faith that notice would create a risk of injury, death, obstruction of an investigation, or harm to a child.

We may seek reimbursement for costs of responding as permitted by law, and we may object to or seek to narrow requests that are overbroad, vague, or legally deficient.
